State Preemption of Local Tobacco Control Policies Restricting Smoking, Advertising, and Youth Access － United States, 2000-2010

喫煙・広告・未成年者の入手を制限する地域たばこ規制方針における州法の専占－アメリカ2000～2010年

より厳しい地域たばこ規制の制定を妨げる専占的な州のたばこ規制法(職場や公共の場での喫煙、たばこの広告、未成年者のたばこ製品入手)の排除は、Healthy People 2020の目標のひとつとなっている。以前の研究では、政府機関の職場内・民間企業の職場内・レストランのうち1ヶ所以上での喫煙規制に関する専占条項を有する州の数が近年かなり減少していることが明らかになった。Healthy People 2020の目標到達に向けた進展状況として、この報告では2000年12月31日から2010年12月31日までのたばこの広告と未成年者のたばこ製品入手の規制に関する専占的州法の数の変化について述べる。州の専占条項に関するデータは、CDCのState Tobacco Activities Tracking and Evaluation(STATE)システムのデータベースより得た。地域喫煙規制に関する専占条項を有する州の数は2000年末の18州から2010年末には12州に減少した。しかしたばこ広告の規制に関する専占条項を有する州の数はこの10年間18州で変化がなく、未成年者のたばこ製品入手の規制に関する専占条項を有している州の数はこの期間中21州から22州に増加した(ペンシルベニア州は2002年に新たな専占条項を制定)。3種類のたばこ規制カテゴリー(職場や公共の場での喫煙、たばこの広告、未成年者のたばこ製品入手)のうちいずれかの専占条項を有している州の数は、2000年末の28州から2010年末には27州に減少した。またこれら3種類のカテゴリー全てに関連した地域活動に関する専占条項を有する州の数は、2000年末の11州から2010年末には7州に減少した。2009年に制定されたFamily Smoking Prevention and Tobacco Control Actにより、たばこの販売規制に関する地域や州の努力に対する関心が回復している。州の専占条項の排除の促進は、関連するHealthy People 2020の目標達成に必要である。
